In absentia

Relating to a legal proceeding, such as a trial or sentencing, conducted without the defendant being physically present in court. A trial in absentia can proceed if a defendant knowingly and voluntarily waives their right to be present or absconds after the trial has begun, thereby forfeiting that right. The Sixth Amendment to the U.S. Constitution guarantees a defendant's right to confront witnesses, making trials in absentia a constitutionally constrained exception.
