Trust intent

The clear and unequivocal intention of the settlor to create a trust, rather than an outright gift or other legal arrangement. This intent must be manifested at the time the trust is created, though no specific words are required. Courts examine the settlor's words and actions to determine if a trust was genuinely intended.
