Term · Law · MLC-T-LAW-004475

A trust in which the person who creates and funds it is also a beneficiary. Under the general rule in most states, reflected in the Uniform Trust Code, creditors of the settlor can reach the most the trustee could distribute to the settlor. A minority of states, including Alaska, Delaware, and Nevada, authorize domestic asset protection trusts that shield assets from the settlor's later creditors, subject to fraudulent transfer rules.
