Likelihood of survival test

Term · Law · MLC-T-LAW-003051

A causation test used mainly in homicide cases, under which a defendant's act counts as a cause of death if it reduced the victim's chance of surviving. It lets a court hold the defendant responsible where the victim was already at risk, because the act worsened the odds even if death might have occurred anyway.
