Misjoinder

The improper inclusion of a party or claim in a lawsuit. This occurs when a plaintiff or defendant is added to a case without meeting the procedural rules for joinder, or when claims are combined that do not share a common question of law or fact. A court may order the severance of misjoined parties or claims to proceed with the properly constituted parts of the action.
