New matter

A factual allegation or defense raised in an answer that goes beyond denying the plaintiff's claims and adds fresh facts, such as an affirmative defense. Pennsylvania procedure requires it to be pleaded under a separate heading labelled New Matter, and the plaintiff must then file a reply. Under the Federal Rules of Civil Procedure no reply to an answer is required unless the court orders one.
