Nonexempt employee

An employee who is covered by the minimum wage and overtime provisions of the Fair Labor Standards Act (FLSA). These employees must be paid at least the federal minimum wage and receive overtime pay, typically one and a half times their regular rate, for hours worked over 40 in a workweek. Most hourly employees fall into this category.
