Nonlapse statute

A legal provision that prevents a gift or bequest in a will from failing if the beneficiary dies before the testator. Instead, the gift passes to the deceased beneficiary's heirs or to an alternate beneficiary specified in the statute. These statutes vary by jurisdiction, often applying only to certain classes of beneficiaries like lineal descendants.
