Ademption by satisfaction

Term · Law · MLC-T-LAW-000358

The reduction or elimination of a gift in a will because the testator, after making the will, gave the beneficiary a lifetime gift meant to satisfy it in whole or in part. The doctrine stops a beneficiary from receiving both the lifetime gift and the bequest. Intent is decisive, and under the Uniform Probate Code it must be shown by the will, a contemporaneous writing by the testator, or the beneficiary's written acknowledgment.
