Offer of proof

A statement made by an attorney to a judge, outside the hearing of the jury, describing the evidence that the attorney intends to present and its relevance to the case. This is typically done when the judge has ruled against the admission of certain evidence. The purpose is to preserve the issue for appellate review, as required by rules of evidence such as Federal Rule of Evidence 103(a)(2).
