Plant patent

A form of intellectual property protection granted to an inventor who has discovered and asexually reproduced a new and distinct variety of plant. This patent prevents others from reproducing, selling, or using the plant for 20 years from the date of filing. It applies to cultivated sports, mutants, hybrids, and newly found seedlings, but not to tuber-propagated plants or plants found in an uncultivated state.
