Post-answer default judgment

Term · Law · MLC-T-LAW-003814

A judgment entered against a defendant who has filed an answer to a complaint but subsequently fails to appear for trial or otherwise defend the case. Unlike a standard default judgment, which occurs when no answer is filed, this type of judgment acknowledges the defendant's initial participation. The court may still require the plaintiff to present evidence to establish damages.
