Purchase money resulting trust

An implied trust that arises when one person pays the purchase price for property, but title to that property is taken in the name of another person. The law presumes that the person who paid for the property intended to retain the beneficial interest, and the titleholder holds the property in trust for the payer. This presumption can be rebutted by evidence of a gift or loan.
