Resulting trust

An implied trust that arises by operation of law when a person transfers property to another, but the circumstances indicate that the transferor did not intend for the transferee to have beneficial ownership. It is presumed to arise in situations where the legal title is separated from the beneficial interest, such as when property is purchased in one person's name but paid for by another. The law presumes an intention to create a trust, not a gift.
