Real party in interest

The person or entity who possesses the actual right to sue or be sued in a legal action. This party is the one who will be directly benefited or injured by the outcome of the lawsuit, regardless of whose name appears on the formal pleadings. Federal Rule of Civil Procedure 17(a) requires that every action be prosecuted in the name of the real party in interest.
