Retaliatory eviction

An unlawful eviction initiated by a landlord in response to a tenant's exercise of a legal right, such as reporting housing code violations or joining a tenants' union. Many state laws prohibit landlords from evicting tenants for a specified period after such protected activities. This defense can be raised by a tenant in an unlawful detainer action.
