Retrial

A new trial of a case that has already been heard in court. This occurs when a previous trial resulted in a mistrial, a hung jury, or when an appellate court overturns a conviction or judgment and sends the case back for further proceedings. The rules governing retrials are set forth in procedural codes, such as the Federal Rules of Criminal Procedure.
