Simultaneous death act

Term · Law · MLC-T-LAW-004559

A statute governing the passing of property when two or more people die together, or in circumstances where it cannot be shown who survived. Under the original uniform act, each person's property is distributed as though that person had outlived the other. The later Uniform Simultaneous Death Act instead requires a beneficiary to survive the decedent by 120 hours, and a beneficiary who does not is treated as having died first.
