Sine qua non

An indispensable condition or action without which a specific result or event would not have occurred. In tort law, this concept is the foundation of the 'but-for' test for factual causation, which asks if the injury would have happened but for the defendant's act. Establishing this type of causation is a necessary first step before considering the issue of proximate cause.
