Preempted causation
Term · Law · MLC-T-LAW-003838
A concept in tort law where one wrongful act would have caused the harm, but another independent wrongful act occurred first and would also have caused the same harm, thereby preventing the first act from being the actual cause. This arises in situations with multiple sufficient causes where one cause effectively negates the causal role of another. Courts analyze which act was the true proximate cause of the injury.
