State action requirement

The legal principle that constitutional protections, particularly those in the Fourteenth Amendment, apply only to actions taken by a government entity, not by private individuals or organizations. A plaintiff alleging a violation of constitutional rights must first demonstrate that the challenged conduct constitutes governmental action. The Supreme Court established this doctrine in the Civil Rights Cases (1883), and courts now use tests like the 'public function' or 'entanglement' tests to determine if a private entity's actions are attributable to the state.
