Substantive due process

A principle of constitutional law that protects individuals from arbitrary or unreasonable government actions that infringe upon fundamental rights. It requires that laws not only be applied fairly, but also be fair in their content and purpose. This doctrine has been used to protect rights not explicitly listed in the Constitution, such as privacy.
