Fundamental right

A right recognized by the Supreme Court as requiring a high degree of protection from government infringement, often because it is explicitly or implicitly guaranteed by the Constitution. Infringement of such a right is subject to strict scrutiny, requiring the government to show a compelling state interest and narrowly tailored means. Examples include freedom of speech, the right to privacy, and the right to marry.
