Third-degree instruction
Term · Law · MLC-T-LAW-004912
A supplemental instruction given to a deadlocked jury, better known as the Allen charge, urging the jurors to keep deliberating and to reconsider their views in light of the views of the others, without giving up honest convictions. It is also called the dynamite charge, shotgun instruction, or hammer instruction. Courts criticize it as coercive toward jurors in the minority, and some states restrict or prohibit it.
