Mixed-motive instruction

A jury instruction given in employment discrimination cases where both legitimate and discriminatory reasons motivated an adverse employment action. This instruction directs the jury to find for the plaintiff if discrimination was a motivating factor, even if other lawful reasons also existed. It shifts the burden to the employer to prove they would have made the same decision absent the discriminatory motive.
