Obviousness

A patent-law test of whether the differences between a claimed invention and the prior art would have been apparent, at the relevant date, to a person with ordinary skill in the field. An invention that fails the test cannot be patented even if it is new, so it is a separate hurdle from novelty. In the United States the test is found in section 103 of the Patent Act, and in the European Patent Convention the corresponding requirement is called inventive step.
