Disparate impact discrimination

A form of employment discrimination that occurs when a neutral employment policy or practice, applied equally to all employees, has a disproportionately negative effect on a protected group. Unlike disparate treatment, it does not require proof of discriminatory intent. Employers can defend against such claims by showing the policy is job-related and consistent with business necessity, and that no less discriminatory alternative exists.
