Accessory before the fact

An individual who, though not present at the scene of a felony, procures, counsels, or commands another to commit the crime. This person's involvement occurs prior to the commission of the offense. Modern statutes often treat accessories before the fact as principals, subject to the same penalties as those who directly commit the crime.
