Anticipatory breach

A clear and unequivocal indication by one party to a contract, before the performance is due, that they will not fulfill their contractual obligations. This allows the non-breaching party to immediately sue for damages without waiting for the actual breach date. The non-breaching party may also suspend their own performance.
