Ascertained

Established with certainty, whether a fact, an amount, or an identity. In wills and trusts a beneficiary or class must be ascertained or ascertainable when the gift takes effect, or the gift can fail for uncertainty. In the law of sale of goods, goods are ascertained when they are identified in accordance with the contract after it is made, and under English law property in unascertained goods cannot pass to the buyer.
