Change of circumstances

A material alteration in the facts or conditions upon which a previous legal order or agreement was based, justifying a modification of that order or agreement. This concept is frequently applied in family law, particularly in requests to modify child custody, visitation, or support orders. The party seeking the modification bears the burden of proving the change of circumstances to the court.
