Collusive suit
Term · Law · MLC-T-LAW-001066
A legal proceeding where the plaintiff and defendant secretly cooperate to obtain a judgment that benefits both, often at the expense of a third party or to evade a legal obligation. This type of suit lacks a genuine dispute between the parties. Courts will dismiss a collusive suit if its true nature is discovered, as it undermines the adversarial system.
