Descriptive mark
Term · Law · MLC-T-LAW-001590
A type of trademark that directly describes a characteristic, quality, ingredient, or function of the goods or services it represents. Because they lack inherent distinctiveness, descriptive marks are not immediately eligible for federal trademark registration on the Principal Register. They can gain protection only after acquiring 'secondary meaning,' which is established by showing that the public primarily associates the mark with a specific producer rather than the product itself.
