Secondary meaning

A legal principle in trademark law where a descriptive term or mark acquires distinctiveness in the minds of consumers through extensive use and advertising. This acquired distinctiveness allows a mark that is not inherently distinctive to be protected as a trademark. Evidence of secondary meaning includes consumer survey data, advertising expenditures, and the length and exclusivity of the mark's use.
