Dilution

Term · Law · MLC-T-LAW-001615

  1. The weakening of the distinctiveness of a famous trademark, even if there is no likelihood of confusion among consumers. This can occur through blurring, where the mark's ability to identify goods or services is impaired, or tarnishment, where the mark's reputation is harmed. Federal law, specifically the Lanham Act, provides protection against trademark dilution for famous marks.

  2. (trademark) The weakening of the distinctiveness of a famous trademark by unauthorized use, even if there is no likelihood of confusion among consumers. This occurs when a junior user's mark reduces the capacity of the famous mark to identify and distinguish goods or services. Trademark dilution laws, such as the Federal Trademark Dilution Act, protect famous marks from such erosion of their commercial value.
