Disparate treatment

A legal theory in anti-discrimination law where an employer or other entity treats an individual differently based on their membership in a protected class. This requires proof of discriminatory intent, either direct or inferred from circumstantial evidence. The McDonnell Douglas framework is often used to analyze disparate treatment claims in employment discrimination cases under Title VII.
