Doctrine of worthier title
Term · Law · MLC-T-LAW-001704
A common law rule that prevented a grantor from conveying an interest in land to their heirs if the grantor retained a life estate or other interest. It presumed that a grantor intended for their heirs to take title by descent (inheritance) rather than by purchase (grant). This doctrine has been abolished or significantly modified in many jurisdictions due to its historical complexities and interference with grantor intent.
