Shelley's case
Term · Law · MLC-T-LAW-004527
A historical rule of property law, formally known as the Rule in Shelley's Case, which operated to prevent the creation of successive interests in land. If a grantor conveyed property to a person for life, with a remainder to that person's heirs, the rule would convert the remainder into a fee simple interest for the life tenant. This common law rule was abolished in most jurisdictions due to its complexity and tendency to frustrate grantor intent.
