Term · Law · MLC-T-LAW-001742

A legal doctrine inferred from the Commerce Clause of the U.S. Constitution, which prohibits states from enacting laws that unduly burden or discriminate against interstate commerce, even in the absence of conflicting federal legislation. This doctrine prevents states from creating economic protectionism for their own industries. Courts apply a balancing test to determine if a state law violates this principle.
