Exceptional case

A legal proceeding with circumstances so out of the ordinary that it justifies a departure from standard rules, such as the principle that each party pays its own legal fees. A finding that a case is exceptional can permit a court to shift the cost of litigation to the losing party. Federal statutes, such as the Patent Act under 35 U.S.C. § 285 and the Lanham Act for trademarks, explicitly provide for the award of attorney's fees in such instances.
