Extrinsic fraud
Term · Law · MLC-T-LAW-002020
Fraud that prevents a party from having a fair opportunity to present their case in court, thereby affecting the integrity of the judicial process itself. This type of fraud occurs outside the actual trial or hearing, such as bribing a judge or preventing a witness from testifying. It provides grounds for a court to set aside a judgment, unlike intrinsic fraud which relates to evidence presented during the trial.
