The unauthorized use, reproduction, or distribution of a protected right or property, such as a patent, copyright, or trademark. This act violates the exclusive rights granted to the owner of the intellectual property. Legal action can be taken to seek damages or an injunction against the infringing party.
(of copyright) The unauthorized reproduction, distribution, public display, public performance, or creation of derivative works from a copyrighted work. This occurs when someone uses copyrighted material without permission from the copyright holder. Remedies for copyright infringement can include statutory damages, actual damages, and injunctive relief under the Copyright Act.
(of trademark) The unauthorized use of a trademark or a confusingly similar mark in connection with goods or services, causing a likelihood of confusion among consumers. This action violates the exclusive rights of the trademark owner. Remedies for infringement can include injunctions, monetary damages, and the seizure of infringing goods.
(of utility patent) The unauthorized making, using, selling, offering for sale, or importing of a patented invention within the United States during the term of the patent. This occurs when a party performs any of these actions without the patent holder's permission. Patent infringement can be direct, indirect, or contributory, and is governed by Title 35 of the U.S. Code.
