Vicarious infringement

A form of secondary liability for copyright or patent infringement where a party has the right and ability to supervise the infringing activity and derives a direct financial benefit from it. The party does not need to have direct knowledge of the infringement. This doctrine holds those who profit from and control infringing acts responsible.
