Jeopardy

The risk of conviction and punishment faced by a person accused of a crime. The Fifth Amendment to the U.S. Constitution protects individuals from being subjected to double jeopardy, meaning they cannot be prosecuted twice for the same offense after an acquittal or conviction. This protection attaches when the jury is empaneled or the first witness is sworn in during a bench trial.
