Liberman v. Riverside Memorial Chapel

A 1996 decision of the New York Appellate Division, First Department, in which a funeral home was held liable and a jury's punitive damages award upheld after a decedent's body was mishandled in connection with an unauthorized autopsy. The court treated disrespectful handling of a corpse as a wrong against the next of kin, who hold the right to receive the body for burial. Later New York decisions cite it for the availability of punitive damages when egregious conduct accompanies an unauthorized autopsy.
