Special appearance

Term · Law · MLC-T-LAW-004605

A defendant's limited appearance in a lawsuit made only to contest the court's personal jurisdiction over the defendant, for example for lack of minimum contacts or defective service, without consenting to the court's authority. At common law, asking for any other relief turned it into a general appearance that waived the objection. Federal Rule of Civil Procedure 12(b) abolished the distinction, while Texas Rule of Civil Procedure 120a still requires a special appearance.
