Star Athletica v. Varsity Brands (2017)
Term · Law · MLC-T-LAW-004667
A U.S. Supreme Court case that clarified the standard for copyrighting useful articles, specifically addressing whether design elements of cheerleading uniforms could be protected. The Court held that a feature of a useful article is copyrightable if it can be identified separately from the utilitarian aspects of the article and is capable of existing independently as a work of art. This decision provided a two-part test for design copyrightability.
