Supervening cause

Term · Law · MLC-T-LAW-004778

An intervening event after a defendant's negligent act that is unforeseeable and sufficient to break the causal link between that act and the plaintiff's injury. When an event qualifies, the original negligence is treated as a mere condition and the defendant is relieved of liability. Courts use the term for the same concept as a superseding cause.
