Triple identity test
Term · Law · MLC-T-LAW-004990
A legal standard used to determine if the principle of res judicata (claim preclusion) applies to a subsequent lawsuit. This test requires that the second lawsuit involves the same parties (or their privies), the same cause of action, and the same subject matter as the first lawsuit that has already been judged on its merits. If all three identities are met, the doctrine bars the new litigation to prevent re-litigating issues that have been or could have been decided.
