Res nova

A legal question or case that has not previously been decided by a court, presenting a novel point of law. When faced with a res nova, a court must establish new precedent by interpreting existing statutes, constitutional principles, or persuasive authority from other jurisdictions. This concept is the opposite of res judicata, which applies to a matter that has already been judged and is conclusive between the parties.
